Terms and conditions for the utilisation of the GeTicket website – Updated on 22/03/2017
The following “Terms and conditions for the utilisation of the GeTicket website” (“Terms and Conditions”) regulate the relations between UniCredit S.p.A. (hereinafter “UniCredit”), with registered office in Rome, via A. Specchi 16 and head office in Milan, piazza Gae Aulenti 3, share capital € € 20.846.893.436,94 fully paid up, registration number in the companies register of Rome, tax code, and VAT number 00348170101, member of the Inter-Bank Fund for the Protection of Deposits, bank registered in the Register of Banks and parent company of the UniCredit Banking Group - Register of Banking Groups code 02008.1, holder of the GeTicket trademark, and the users of the GeTicket as described hereafter.
1. Object of the Service
1.1 The GeTicket service (“Service”) consists in UniCredit providing an intermediation service, in the name and on behalf of third parties, for the on-line sale through the websitewww.geticket.it (the ”Site”):
a) of admission tickets (“Tickets”) for music, sports, theatre, cultural, and, in general, entertainment events organised, managed, and offered by third parties and not by UniCredit (hereinafter “Organisers”); and
b) of various other goods and services within the sectors of sports, shows, culture, and/or transportation (“Products”) offered by third parties and not by UniCredit (hereinafter “Sellers”).
1.2 UniCredit reserves the right to modify these Terms and Conditions at any time, and without having to give any advance notice. The user is responsible for verifying the Terms and Conditions before starting to navigate the Site, without prejudice to UniCredit's undertaking to suitably highlight the changes made, as far as possible. The user has the exclusive responsibility for verifying, whenever he/she accesses and navigates the site, whether any changes were made to the Terms and Conditions.
1.3 The contents of the Organisers and Sellers published on the site shall concern specific music, sports, theatre, cultural, and, in general, entertainment events and/or products and services. In any case, all contents referring to the Organisers and Sellers, also jointly, are prepared and produced by said Organisers and Sellers under their own exclusive responsibility and care, and at their choice; therefore, they are imputable exclusively to their conduct and responsibility. Consequently, UniCredit does not assume any responsibility and does not provide any guarantee, endorsement, or insurance for said contents.
1.4 The Customer undertakes to purchase the tickets on Geticket for personal use only with the exclusion of profit-making business or resale to third parties made in violation of legal requirements or these terms and conditions.
1.6 UniCredit offers the intermediation service for the ticket sale in its own name and for a third-party account, also through other sales channels that can be consulted on the UniCredit web page
2. Access to the Service
2.1 In order to use the Service, the user must:
(a) accept these "Terms and Conditions;"
(b) fill out the on-line form requesting the user's personal data and authorise their processing by UniCredit in accordance with the information on privacy published on the Site;
(c) provide an active and accessible email address (“Username”), and choose a personal access password (“Password”).
2.2 The Username and Password are the access credentials that univocally identify the user and allow him/her to log in to the site; therefore, they are strictly personal and cannot be used from two different workstations at the same time and they cannot be transferred or assigned to third parties. The user must keep his/her registration data up to date and ensure that they are valid, truthful, accurate, and correct and that they do not violate the rights of third parties. The user will be unable to utilise the Service if he/she fails to fill out all fields indicated as compulsory in the on-line form requesting the user's personal data.
2.3 The user shall be fully responsible for all transactions conducted using his/her access credentials. Therefore the user must keep said credentials strictly confidential and secret and must inform UniCredit immediately, through the GeTicket Customer Service, if they are utilised without the user's authorisation. Each user shall be held fully liable for all actions or deeds performed using the user's access credentials; UniCredit cannot be held liable in any way for any improper or unlawful use of the access credentials by the user or any third party whatsoever.
2.4 Each user can only register once. It is, therefore, absolutely forbidden to create multiple accounts on the same natural person, despite the correctness of the data entered. In case of infringement, without prejudice to the provisions of Article 2.5 below, Unicredit reserves the right to shut down all the accounts connected to the same person. The User undertakes to take Unicredit safe and protected from any damage or liability obligation regarding this infringement referred to in this article.
2.5 UniCredit reserves the right to prevent a user from accessing the Service and to stop the validity of the access credentials, immediately and without notice, if it believes that the provisions of these general conditions for the utilisation of the Service have been substantively violated and/or if it established that:
(a) the user's data are not truthful, valid, accurate, correct, and/or up-to-date; and/or
(b) there have been events related to the unlawful use of the access credentials; and/or
(c) the Service has been used improperly or for unlawful purposes; and/or
d) the tickets have been purchased for resale to third parties (even if without price increase); and/or
(e) there is a justified reason.
2.6 The Service is reserved to users who have attained legal age. If the user is a minor, he/she can utilise the Service by involving a parent or guardian.
3. Procedure to purchase Tickets and Products
3.1 The user can view the information regarding the Events and Products available for sale from time to time and select the Tickets and/or Products to be purchased.
3.2 The user can consult the information sheet concerning the Event and/or Product that interest him/her and read all related information and characteristics, pre-contractual information, and general sale conditions provided by the Organiser and/or Seller.
3.3 The purchase of the Ticket and/or Product is always subject to the prior reading of the pre-contractual information and to the approval, at the time of the completion of the purchase, of the general purchase conditions, prepared by the Organiser and/or Seller and found in the website pages concerning the Ticket and/or Product that the user intends to purchase.
3.4 The price of the Tickets and Products is shown in the related information sheet and includes any pre-sale fees and expenses applied by the Organiser and/or Seller. Any surcharges related to specific Events and/or Products shall be explicitly highlighted in the general summary page before the payment phase.
3.5 The prices of Tickets and Products, service commissions, and any shipping costs, as well as any other price shown on the Site are understood to include the applicable VAT.
3.6 The payment procedure must be completed entirely in order to finalise the purchase. The purchase transaction cannot be finalised if the payment procedure is not completed.
3.7 The price of the Ticket and/or Product is that communicated by the Organiser and/or Seller at the time the user completes the purchase transaction. Any lower price that might be applied after the user makes the purchase: - by the Organiser to tickets of the same type or for Events to be held on a given date; - by the Seller to the Product purchased by the user; does not entitle the user to be reimbursed the difference.
3.8 It is not possible, under any circumstances: - to replace the Ticket with a different Ticket for another Event; - to issue a copy of the Ticket.
3.9 It is absolutely prohibited the purchase of the tickets in order to resale them to third parties (even if without price increase); in this case Unicredit reserves the right to cancel the tickets and to report instances of abuse to the competent authorities in the context of secondary ticketing.
4. Payment methods and security measures
4.1 The user must pay the price indicated by the Site at the time of the purchase order, following the instructions given there each time. The payment method is shown in the general summary page that precedes the payment phase.
4.2 On-line transactions can be paid for by MASTERCARD, AMERICAN EXPRESS, DINERS, VISA, and VISA ELECTRON credit card or other if otherwise specified in the summary page mentioned at the preceding point; or they can be paid for by debiting a current account if the user is member of the Banca Multicanale [Multi-channel Bank] service offered by UniCredit to its customers.
4.3 If the payment is not carried out correctly, UniCredit can cancel the related order at any time.
4.4 If the user claims the cancellation/invalidity/non-effectiveness of the payment order, UniCredit and the Seller retain the right to bring legal action, also through third parties mandated by UniCredit and the Seller, before the judicial bodies having jurisdiction, to recover from the user the payment due, in addition to the related charges and expenses and compensation for damages.
4.5 In order to ensure the greatest possible security, the on-line purchase transactions on the Site are conducted through a secure server, with VeriSign certification, which uses the SSL (Secure Socket Layer) protection system.
5. Confirmation of purchase
5.1 After the purchase is finalised, an email confirmation is sent to the user at the address indicated by the user at the time of registration.
5.2 If the user does not receive confirmation of the purchase, he/she can ask the GeTicket Customer Service to re-send it, making sure to specify the order number shown in the Site's Personal Area under "Reservations List." The user can also independently download the confirmation from the Site utilising the appropriate function in the Personal Area.
5.3 UniCredit declines all responsibility for the failure to deliver the confirmation email if delivery was made impossible by the fact that the user entered incorrect or invalid data in the on-line form requesting the user's personal data.
6.1 The methods used to deliver Tickets and Products to the user-purchaser are specified in the general summary page that precedes the payment phase.
6.2 Various types of delivery are possible:
- COLLECTION AT THE BOX OFFICE: the user must call at the box office of the selected Event starting one hour before the Event and produce the printed purchase confirmation and an identification document. If the ticket is collected by a person mandated by the user, said person must have the collection voucher sent by UniCredit, a personal identification document, a delegation by the user, and a copy of an identification document of the user;
- COLLECTION AT A SALE POINT: unless otherwise provided in the pre-contractual information and in the general sale conditions provided by the Seller, the user must call at the sale point indicated by the Seller at the time the product was purchased and produce the printed confirmation of the purchase and an identification document. If the Product is collected by a person mandated by the user, said person must have the collection voucher sent by UniCredit, a personal identification document, a delegation by the user, and a copy of an identification document of the user;
- TICKETLESS (submission of a document “printed at home con barcode”): if the user so chooses, when this option is available during the purchase process, access to the Event can be obtained by producing the printed version of the voucher received by email;
- DELIVERY TO THE USER'S RESIDENCE: when this option is available during the purchase process, the user can ask delivery at home by express courier. The user shall bear the shipping costs. The methods and terms of delivery are shown in the purchase confirmation. Delivery is done in accordance with timetables and costs that depend on the place of destination indicated by the user. The user must ensure that he/she communicated, correctly and without errors, the details of his/her residence and, if different, the address to which the purchased Ticket/Product is to be shipped.
7. Changes, rescheduling, or cancellation of the Event
7.1 In the event that the scheduling and/or time of an Event are changed, the ticket holder must address the Organiser directly to have the ticket replaced or the cost incurred reimbursed. The user takes note that the above-mentioned replacement and reimbursement transactions are conducted exclusively in accordance with the provision that the Organiser will communicate each time; in any case, the latter shall have exclusive responsibility for said rescheduling and cancellation of the Events.
7.2 The user takes note that the reimbursement does not cover either the commissions paid for the service provided or any ticket shipping costs. In addition, the Organiser shall have the right to exclude, from time to time, the reimbursement of the pre-sale fees. The user also takes not that, unless the Organiser provides otherwise, the shipping costs for the reimbursement requests shall be borne by the user.
8. GeTicket Customer Service
8.1 The GeTicket Customer Service is available to obtain information regarding the orders placed through the Site and regarding problems with the Site registration process or with access to the Site; it can be contacted as needed at the addresses indicated on the Site and at the email address firstname.lastname@example.org.
8.2 In addition, the GeTicket Customer Service will provide the information and contact references of the Organisers and/or Sellers for the sale and post-sale activities.
8.3 For additional information on returns and withdrawals or to initiate a "Complaint" procedure, the user must refer to the terms, methods, and conditions specified by each Organiser and/or Seller for each Ticket and/or Product in the general sales conditions and/or contact the Customer Assistance Service of the Organiser and/or Seller from which the user made the purchase.
9. Right of withdrawal
9.1 Pursuant to art. 59, paragraph 1 letter n), of Legislative Decree No. 206 of 6 October 2005 (the “Consumer's Code”), the exercise of the right of withdrawal mentioned at articles 52 and following of said Consumer's Code is not applicable to the transactions for the purchase of Tickets finalised through the Service.
9.2 On the other hand, the right of withdrawal applies to the remote purchase of Products, provided that the user-purchaser qualifies as a Consumer in accordance with the Consumer's Code, unless said goods fall within the categories for which said right of withdrawal is expressly excluded by art. 59 of the Consumer's Code. In this case, the right of withdrawal can be exercised within the 14 days following the date on which the user acquired physical possession of the good purchased, or within the 14 days following the date on which the user concluded the contract for the service purchased.
9.3 The user is invited to read carefully the general sales conditions published on the Site by each Organiser and/or Seller for each Ticket and/or Product; said sales conditions specify the terms, methods, conditions, exclusions, and limitations concerning the exercise of the withdrawal right.
10. Limitation of liability and guarantees
10.1 Except in the case of malice or gross negligence, UniCredit does not assume any liability for damages, direct or indirect, of any nature, losses, harm, and expenses derived from the unavailability or malfunction of the Service and, specifically, of the Site.
10.2 UniCredit's liability is excluded in case of failure to comply with its contractual obligations due to force majeure, meaning any event that can be considered outside UniCredit's reasonable control, such as, by way of example: malfunctions, interruptions, delays, or errors due to the power or internet network and, in general, any action or deed, also of third parties, that is not under UniCredit's control or imputable to UniCredit, including cases of: i) unavailability or faulty operation of the on-line payment procedures; ii) cancellations and rescheduling of the Events by the Organiser; iii) delays of the express courier in delivering the Tickets and/or Products.
10.3 The user bears exclusive responsibility for equipping his/her electronic devices, used to access the Site through the internet network, with software and systems intended to guarantee secure navigation through the web and adequate protection from viruses and other malware.
10.4 When providing the Service, UniCredit acts also on behalf of third party Organisers and bears no responsibility in the management and organisation of the events published through its Service. In this regard, it is pointed out that the Events published through the Service can undergo changes independently of UniCredit's will. Therefore, UniCredit cannot be held liable in any way for any programme changes of the Events published through the Site and, for this reason, the user must verify, always and in all cases, the scheduled Events directly on the official site of the respective Organisers. Also, UniCredit cannot be held liable in any way for any damage, discomfort, inconvenience, or disservice experienced by the user of the Service for facts imputable to the Organisers and in case of cancellation or rescheduling by the Organisers of the Event for which the Service provided the Ticket.
10.5 All guarantees, including legal guarantees, related to the contents of the Sellers and to the Products object of the respective Offers, as well as any contractual relationship between the user and one or more Sellers are the exclusive responsibility and obligation of the respective Seller, which bears exclusive responsibility for the activity that it carries out, and is the only guarantor and entity responsible for the products and services offered. UniCredit does not provide any guarantee or endorsement of the contents, and of the completeness and correctness of the contents, offers and documents published on the Site in the Sellers' pages; also, UniCredit does not assume any responsibility regarding the products and/or services advertised by the Sellers and/or regarding the contents and the completeness and correctness of the pre-contractual information and of the general sale or service supply conditions prepared by the Sellers and displayed on the Site for each offer. Within the limits provided by the applicable law, UniCredit excludes any express or implicit guarantee and shall not be liable for damages of any kind caused by the use of this Site, including, merely by way of example, direct, indirect, accidental, punitive, and consequential damages. In addition, UniCredit shall not answer or assume any responsibility, obligation, or guarantee for any action, damage (including indirect damages), harm, loss, proceedings, penalty, or claim experienced by the user as a result of accessing the Site and navigating through it.
11. Industrial and intellectual property rights
11.1 All contents found or made available through the Site, specifically text, figures, icon buttons, files, digital downloads, databases, and software are protected by the copyright and industrial and/or intellectual property legislation; specifically, trademarks, names, logos, domains, company names, companies, and banners found on the site are the property of the respective owners; therefore, they are protected by the legislation in effect regarding distinctive signs.
11.2 The user is given only the personal right, not exclusive and not transferable to third parties, to access and utilise the site and to navigate through it and to consult the related web pages and contents within the limits allowed by the Site, excluding any other right and privilege; therefore, it is expressly forbidden to copy and/or reproduce, in any form, in whole or in part, web pages, photographs, texts, or other elements of the Site and contents without the prior authorisation of UniCredit and /or respective third party owners.
11.3 All software used in this Site is the property of UniCredit or of the respective owners and is protected by Italian law and by international regulations on copyrights and intellectual property rights. It is not permitted to frame or utilise framing techniques to unduly appropriate any trademarks, logos, or other proprietary information (including images, texts, page-setting, or formats) belonging to UniCredit and/or the respective owners.
12. Applicable law and Court having jurisdiction
12.1 These "Terms and Conditions for the use of the GeTicket site” are governed by Italian law.
12.2 If the user of the Service is a Consumer, any dispute concerning the validity, interpretation, implementation and/or termination of legally relevant deeds related to the utilisation of the Service shall be referred to the jurisdiction of the Court of the place of residence or elective domicile of the user.
12.3 If the user of the Service is not a Consumer, any dispute concerning the validity, interpretation, implementation and/or termination of legally relevant deeds related to the utilisation of the Service shall be referred to the exclusive jurisdiction of the Court of Milan.
The user, also pursuant to articles 1341 and 1342 of the civil code, expressly accepts the following contract conditions: art. 1.2 – UniCredit's right to modify the Terms and Conditions; art. 1.3 – limitation of liability; art. 2.3 – exemption from liability; art. 2.4 – right to interrupt the service; art 3.9 – Ban the purchase and the resale of tickets on third parties; art. 4.3 – cancellation of the purchase; art. 5.3 – exemption from liability; art. 7 – changes, rescheduling, or cancellation of the Event – exemption from liability; art. 10 – exemption from liability; art. 12.3 – exceptions to the jurisdiction of the judicial authorities.
